Man wounds robber, then shoots him 5 more times, murder or self defense?

Its not murder. If your stupid enough to rob someone and have a gun then you deserve to be shot and killed. Plus how many of you people claiming this guy is guilty have actually ever been robbed at gun point? Do any of you know what kind of adrenaline rush goes through your body? All these questions being asked about if he was reaching for a gun, if he was conscious and still able to fight, etc are all valid questions. And I'm sure they crossed Ersland's mind in the moment and he addressed them the only way you can in a moment like that. When someone has pulled a gun on you I don't believe it is reasonable for you to have to sit back and make the calculations as to if the kid would still be able to attack or not. In the moment there is only one way to guarantee that kid will not be shooting back and Ersland did it properly.

In my opinion, you pull a gun on someone for any reason other than self defense and you signed your own death certificate.

As for that scumbag, he got what he deserved. Justice is often too soft which breeds perpetual criminal behavior. The moment he walked into that pharmacy and pointed a gun at someone, he signed his life away as far as I am concerned. To truly deter crime, there needs to be some fear in getting caught. Spending time in the local country club obviously isn't working. When you have to worry about getting shot in the head while attempting to steel some pills, or a TV from a strangers living room, or $150 from the corner quick mart - I bet more people will think twice before engaging such behavior.

We dont know if he was conscious either, we were not there to make that assessment, and are you gonna walk up on a guy with a gun that you just shot, whos trying to recover it and bend down and try and take it away form him. Things I guess I guess city/suburb kids never learn " Dont ever mess with a wounded animal" they are unpredictable and many times surprisingly strong even with a head wound this kid could still have the potential to fuck you up. Adrenaline and the will to survive and fight to do so, are a very very powerful combination.


A having a head wound dose not necessary make one dead at that instant, While this is normally the case its not always. I will reference many many, Photos and video shot in many actions through out the world over the last 150 years. There are tons of pic of the walking wounded from the Civil war, I recall one where the guy still had a blood spot the size of a mini ball in his bandage on his "noggin" and a missing leg smiling for the camera = Not dead. WWI, WWII, Korea, Vietnam, all have movie and pic footage of men with head wounds still alive and kicking some still fighting while the corpmen are trying to help them. Though most prolly did die with in a few hours of getting hit.

Hell read the book "lone survivor" One guy had 1/2 his head nearly shot off and when he was found by US forces he had managed to not only draw his side arm but fire it at the approaching taliban he reloaded it 3 times he was on his last mag, after his head wound when he died. One of the others was wounded several times and once in the head and was still firing his fucking rifle while being dragged by the only guy to live. Oh the book if you dont know is a true story about a Navy seal team in Afghanistan in 06 where one guy survived Read it I highly recommend it

Head wound dose not always = death that instant. We dont know if the kid was trying to reaim his weapon or not. Trying to reaim or even reach for the original or another weapon = THREAT. You dont have to get up to aim or shoot, I shoot laying on my chest all the time its call the prone position.

Oh, about the keys to the city thing, YES I do, last time I checked OKC is not "hicksville" its a big city full of, lets just say the down troden that blame the white or "rich" people for all the ills that have befallen them. Rather than get out an make some for them selves they want the Govt to do it for them. After all its not fair that they dont have all the trappings of a successful life that the rest of society has. That class of people (all colors) will lynch this guy, but if it were one of their own the "keys to the city" would be presented so to speak.

The kid was shot in the head... what makes you think he'd be able to reclaim his gun, get up, aim, and kill someone after that? Do we even know if he was conscious? Also, how hard is it to take a gun away from someone who's been shot in the skull? Not very, I'd imagine.

good for him, eliminate the problem. It does not say where in the head he was shot, could have been still able to pull a trigger. Yes 6 total rounds is a bit much but I am sure his adrenaline was really going and probably didnt have any tactical defence training. Good ridance 1 less burden on our jail system.
