There was most likely no premeditation. But it was not accidental either. The guy who lacerated the burglar on several occasions must certaily have known that cutting somebody in pieces is not harmless.

Put yourself in the kid's shoes. There is a stranger in your garage who suddenly lunges at you. You have no idea if he has a gun or other weapon to harm you. You don't hit him once, and then ask him, "are you ok now? can I stop slashing/hitting you?"

I wonder if the student can claim self-defense. The burglar was most likely unarmed and only looking for stuff to steal. Kid can probably get sued by the state. It looks to me like a murder if the student can't prove his life was in danger.
