    She says it is frivolous and if the company had continued to use the photo there would be a case. Now she is pissed off because the OP seems sue happy in the first three posts. She says for him or her to get organized and start a company if their pictures are so good that companies are stealing them for marketing purposes.
    Also the cost of going to court over 2 hours of use (after they were told they couldn't use the photo for free) out weighs the profit. Unless they settled and in such settlement the OP is not allowed to address the outcome. Which may have happened.....

    Here's the thing, (I never saw this, and I will have my lawyer who is standing behind me read through it) DTM F-werks put the picture up, they were then told it wasn't theirs to put up, so they took it down. No harm no foul. Skateboarding companies use all kinds of logos and pictures illegally until they are told they cannot, then they take them down, no harm, no foul. Where a lawsuit may be a good way to threaten someone to stop using your stuff, it probably won't do anything for you if the people you sue basically say "my bad" and take it down immediately.
    OP, take this as a lesson.
