Im with the OP, i dont care if he could have called and had them take the picture down thats beside the point. I think the biggest thing, and i believe when you stated the copyright laws the legal system agrees with me, the fact that they took to time to physically(digitally) remove the watermark from the image gives him the right to ram them for all theyre worth. That being said im not suprised they stole an image, they stole wheel designs from several different companies.
This is business people, there is no place to worry about peoples feelings. I know where i work we check every new product our competition puts out for any possible way it could be seen to infringe upon our patents. Intelectual property is as good as a patent, especially with that copyright law, and the fact they used the photo without acknowledgment or permission, in a business setting none the less, gives him every right to approach them with a legal statement.Leave a comment:

What long thread. I can appreciate what you're trying to accomplish here, mainly stroke your ego and follow the principle of enforcing the law in the most pedantic manner. That's fine, and it's a valid approach. However, as many other fellow forum members have pointed out already getting the law involved might not always be the desired business decision. Your dismissal of this opposing point of view makes for an interesting shit show in this thread.
EDIT: I look forward to an update on your legal battle.Leave a comment:

:pimp: Agreed! Posting in a public does not make it public property, but I'm sure half the individuals who are pissed at OP have an Ipod full of stolen music, the image was watermarked, the water mark was removed, game over! It's like scratching the VIN off a stolen fender, it was placed there to identify ownership, sadly it has become almost impossible to grow a photography business with this new attitude, I'm sure if Cadillac tried this kind of approach and used a "borrowed" photo on the back cover of Road & Track the attitude would be different, but the actions are the same, OP attempted resolve this directly and was ignored, that's what lawsuits are for, it sucks, but time to learn the law!Leave a comment:
