I see your point and I agree with the "defenseless" defense on the cracked window. But, it is not illegal and therefore he was within his rights to keep his window as open as it was. Yes, he could have just complied and opened the window, no big deal, right? But the cop should also know the laws and he should have known that the driver did NOT have to open the window all the way down and therefore he could have just proceeded with his DWI check. I'm not responding to be a prick just playing devils advocate. -
Just like the guy in the dog shooting vid, when one goes out looking for trouble, one will find it. This is a clear set up on the kid's part, I, like someone else mentioned, wonder how many times this kid drove through the check point hoping to be stopped and "questioned" just so he could post a vid on you tube. Did you get that GoPro for your birthday, bro? Why else is the camera set up with a perfect angle to the driver's window?
Yeah, everyone can argue that you have the right to refuse, the right to keep your window barely cracked, etc, but where does that get you? Standing on the side of the road or in the back of a cruiser while the cops toss your car just because you wanted to be the one guy that night that "Knows my rights !!" How many people do you think the cop has run into that don't want to roll their window down further because they really are intoxicated? Does it look like it's that cop's first night on the job? "Oh they can't detain me, they can't arrest me..." Really? Looks like they just did! Maybe it is a pain, maybe it is a game, but I for one would rather just roll my window down a little further as requested and be on my way versus having anyone see me in the "secondary inspection lane" doing the sidewalk olympics or watching everything in my car being thrown around.Leave a comment:

I kind of agree, but not entirely. I would have no recourse if the person I was questioning reached for something quickly. There have been plenty of cases where this has happened where the officer was able to subdue the driver by reaching in the car and stopping them while they were reaching. In most cases the person was subdued without severe injury. With the window cracked like that, you, as an officer, need to make a decision that could ultimately mean death for you or the other party. I don't believe its worth putting someone on the defense to exercise your right to a cracked window. Its asinine. Just roll your window down and have a conversation. I bet you go home without having to deal with a bunch of irate officers and a dog. I bet you won't have any tasty you tube footage though.Leave a comment:

I dont know about you guys but I get nervous as hell when I get pulled over by a cop. Not because I have anything to hide but because you dont know what type of attitude you might encounter. When I was younger I didnt know the laws that well, so if a cop pulled me over for whatever reason, and wanted to check my car, i would just let him. Only later I found out that I did not have to consent to that and that they actually need a warrant to search my car...unless of course he had probable cause. If I got pulled over today, lets say for speeding, and they asked me if they could search my car, and I say no not without a warrant, am I asking for trouble too? Or am I just exercising my rights as a citizen so that I dont get taken advantage of? What if i had a camcorder and recorded the whole thing, am i provoking the situation?
I dont think the kid did anything wrong. I think the cop got upset that this guy decided not to just do as told like everyone else and it caught him offguard.Leave a comment:

There needs to be a reasonable suspicion that a crime has been committed, not a "gut feeling" or dislike of a person's appearance or demeanor. Pulling a person out of a car because they don't want to roll the window down is pure vindictiveness.Leave a comment:

I wonder how many stops this kid went through to get the reaction he was hoping for.
I was just down in Nashville over the 4th and they were saying that all the officers were give. Court orders to take blood tests right on the spot and to not even mess around with a sobriety test. Not sure how it all played out but that sounds a little severe. Especially since how are they going to sterilize the equipment and the test area....oh yeah, with alcohol.Leave a comment:

I don't know if 325ix will come in this thread or not. But, the same sort of shit happened to him. He bought a car in San Diego and was driving it back to New Mexico, through Arizona. Of course it didn't have tags as he had just bought it.I think the problem is that basically everything can be considered "shifty" by any cop at any time.
For instance, the story about the fake drug check points they setup in Ohio so they could see who acted "shifty" then pull them over.
One gentleman who was pulled over had done nothing more than to stop on the side of the road to check his directions (after driving past the sign, so he was OBVIOUSLY ditching drugs, or doing something else illegal), he then gets pulled over and searched.
So, during this trip, as he is driving through AZ with his dad, they pull over at some random exit to switch drivers. A little while after getting back on the freeway they are pulled over by a DEA agent who claims he thought they were running drugs because they pulled off to the side of the road and didn't have tags. He proceeds to berate them, telling them he could have his car impounded for lack of registration. He slaps them with a big fine instead, even after they show him the bill of sale, and tells them they need to tow it the rest of the way.
He gets back to NM after spending money on a Uhaul truck and trailer only to find out that this piece of shit DEA Agent didn't even know the laws of his own fuckin' state. Turns out you have a certain amount of time (I can't recall what it is exactly, but more than 24 hours) to get your car registered after you have bought it, with a bill of sale in hand. Of course, being out of state it would be more expensive to fight the BS ticket than to just pay it...

Its really kind of hard to tell these days if someone is filming for the sole intention of trying to find trouble. Nowadays more and more people are driving around with cameras but given the location of this guys camera (on the pass seat) I do believe he went out with the intention of getting the reaction from the police that got. Besides that I don't think he did anything wrong and the cops were being dicks BUT I do understand the cops have a hard job to do and keeping us all safe. I have had my run ins with the police but I try to make it as painless as possible for me for the reason that I don't need to waste my time to prove anything to anyone. I have nothing to hide but yet I choose to comply with the police as long as I'm being treated as I'm treating them, with respect.
Life is too short to argue with people. If I was going to argue what I thought was right on every occasion I come across I felt was wrong I would spend most of my life arguing...and would probably post on this thread more than once and keep arguing with you fellas.

The bottom line is, however sketchy and weird the kid was, HE HAS RIGHTS as a US citizen. You cannot take away these rights to 'keep roads safe'. Rights exist for a reason. Let's see how you feel about police when you get one who screams in your face and demands to search your car.

I think it also has to do with the fact that noone is armed at the wheel.
But even when I lived in MI, the few encounters I had with the local PD were great, really... and when our home alarm system went off once, they were there within 3-4 minutes. I wasn't in any traffic stops though, so I can't judge that.Leave a comment:
