    Idenfiying yourself and giving your ID are two different matters.

    This isnt soviet russia. Its not a crime to not have your "papers" on you at all times, yet.

    You have to state your name and address (if you have one). Outside of that you are not required to show ID. In fact, if you arent driving you arent required to HAVE ID.

    And there is a flaw in the "Kid is in a commuter lot at night, he must be up to something" ethics. It doesnt quite sum up when applying universality. If you are going into an inner city gas station, are black, and its late at night should the cop detain you under the suspicion you are robbing the place? Its too subjective. In our legal system it doesnt, and shouldnt, hold up. Many legit cases are lost because of this. Unless they arrest you under reasonable suspicion of doing (or doing) an illegal act everything they do is illegal.

    And there should be a backlash, we should go too far in the other direction now. Start canning cops that come even close to this bullshit. ITs how the system works. Someone breaks a rule, you NAIL everyone else who even bends it, and then you can relax knowing that everyone will be in line because the consequences are dear.

    We should publicly lynch this asshole and Nifong. That would prevent future misshaps.

      I tend to agree, but I think you need a little more than what you have listed on "b" as probable cause. It gets close, but I think you need some action on the part of the "suspect" that the from which the cop can state a reasonably articulable basis for suspicion of possible criminal activity.

      If I am standing on the corner at crackhead central at 3am, that is not enough. But if he sees me interacting with people in such a way to suggest possible drug activity - Bingo! you have probable cause.

          I think that we can all agree that the kid is not guilty of anything other than being a smart-ass. But the lesson to be learned here is to not be a smart-ass if you don't want to be hassled by a cop.

          There is a difference between what is legal and what is wise.

            I think the police should be continously recorded and should be punished for being a prick at any time even if the person is a prick. Just my 2 cents.

            Heres a conversation I had when getting a seat belt ticket.

            cop: Liscense, registration, insurance
            Mrsuburban: handing liscense and continuing to scuffle through glove box.
            Mrsuburban: gets out of truck and to look behind seat.
            cop: Is that a purse in there! (Saying in such a tone that I was a thief)
            Mrsuburban: No its a camera bag, see look theres a camera in it.
            cop: Finds out I have a clean record and dont steal purses even though I drive a big black ford truck.

                  Yeah, I wish I could have caught this young 20-something prick cop who pulled me over for a blown headlight while I was in Winchester VA. I had my license and registration and money in my laptop bag which was all in the back of the truck when he pulled me over. I told him where he could find everything (because he wouldn't let me get out) and he said, "You have an awful lot of money here. What is this for?" After I explained to him that I have to travel with a substantial amount of cash because tow truck drivers don't take American Express, he said, "well I am going to let you keep this money, however, I have your information and I better not find anyone out here with a large supply of drugs or I am going to send the troops after you! Now you run along and be good."

                        1. After watching the news reel, that kid was baiting. Small town, trouble with police prior, and his general attitude towards the reporter's question.

                        2. The officer has every right to be suspicious of someone parking in a commuter lot at 2am. He stated why he was suspicious and that should be enough reason to investigate.

                        3. The officer was out of line. He should be reprimanded for his attitude and the way he handled the situation.

                        4. He was baited.

                        Ryan, there was no arrest. Just an investigation at 2am in a commuter lot that cars have been stolen from prior.

                          It wasn't his line of questioning so much as it was his attitude when he wasn't buying my answer. Either this was his nice way of letting me off the hook or he forgot to give me the ticket. Through the verbal exchange he never even went back to his car to check my credentials.

                                Come on man.. you really think that the AP is going after a group of bimmerheads over copyright infringement? I am sure that the AP gets infringed upon by much larger organizations on a regular basis.

                                But I agree with the cop getting canned over the fact that he did not cover himself and tape the traffic stop. If I was his supervisor I would have given him the benefit of the doubt with a minimal punishment because I would have had something credible enough to defend him and his position.
