    “We are in the early stages of the investigation, but right now we’re treating it as a burglary and the homeowner defending his property,” Smith said.

    Investigators will present their findings to a grand jury but don’t expect an indictment.

    “Your home is your castle, you can only retreat so far as your home,” Smith said.

    “I’m sure at the time he felt he was in danger so he took what action he thought he needed to take at the time to protect himself… You can back away from anything but home is as far backwards as you can go. At what point do you leave your house to let them have it?

    “If that’s even a question, and in my mind, it wouldn’t be,” he said.

    Investigators said the homeowner fired just one shot with his shotgun, and Smith said he is sure this will be viewed as a victory for people in the pro-gun crowd.

    “Things like this probably happen everyday and fortunately it doesn’t happen everyday in our county or neighborhood. I’m a supporter of the second amendment and you do what you’ve got to do and you use what tools are necessary,” Smith said.

    Police have not released the intruder’s identity as they are working to locate and inform his family, but Smith said police are familiar with the burglar from previous investigations.

    Because the people simply can't be trusted to have 10. Those 3 cartridges can turn a soccer mom into a deadly mass murderer. Think of the children. If it only saves one life.

    Has nothing to do with the bullets inside, they simply want to eliminate the majority of firearms being sold in-state. No MFG is going to make a special NY compliant 7rd mag. They just want guns purged from the state.

    Unless you have a true standard 1911 Mag, that only holds 7 or a pocket pistol that only holds 6 or a BAR that only holds 4-6 depending on caliber. Other wise YES your right ;)

    I have had to pull my gun one time and one time only and I was happy I had it. Pulled up to a stop light in a bad part of town at about two am and i saw somebody on foot creeping across the road headed toward me, they were hooded up and looked to be up to no good.
