He was being overly strict on some evap rules. If I I ‘modify’ fuel sensors to work in my tank then that’s ‘modifying’ the emissions system. I argue that everything in the tank is part of the evap system where the law states that components can be integrated to use with the full functionality (DTML) of the new system. Different coding will change the calibration number I believe, so that’s a no-go. I just read some diagrams yesterday and realized I need the JBE for the fuel level and at least two other modules. I can wire them with minimum 15, 30,31 and CAN, plus any needed sensors. This will no-doubt be stupidly complicated. If I get to the ‘impossible’ point, I’m humble enough to throw in the towel. I’m not there yet but it’s getting close. This might end up being a nice 6spd to put behind my 4 banger that I hate.

part of me thinks that if I show up with a very clean install including airbox and cats, all the monitors run and a clean dyno run with an e90 instrument cluster with a functional check Eng light and working speed and fuel gauge that I would get the thumbs up.

You say "Where are your other two cylinders?"
I say "Where's your other camshaft?"
    Frankenmotor: if an M42, M44, M20, S50, and S52 were to have a kid.

Small update. Got my DME and CAS married. Car starts and runs great. I think an N52 will feel like a powerhouse in a e30

And while fitting an E90 tank is right out (too wide both longitudinally and transversely),some initial measurements on a 1-series tank show some hope. Haven’t committed to the fuel tank thing yet but still pursuing options.

Good, because I’m tired of slow cars.

Working on prep for mine, I'll race you to making the engine run, then evap happy.

As far as BAR goes, your ref seems to be overly harsh on evap for an OBD1 car. If you can make the car run and pass monitors on the DME, you're done. Good notes on the DTML, I need to look deeper into it and probably make some junkyard runs.

CATs do need to be as close as possible to factory location to keep refs happy. The process isn't very standardized but it is rigid. Most of my experience is helping friends with E-rod swaps (EO number, much easier) and they have a lot of experience with M50 BAR swaps. N52 seems like it's reasonable to get it to run but challenging to follow through on the BAR sticker. Rooting for you, but there will probably be some fabrication involved on the car to get the CATs where they need to be

ill bet you’re done first. But after driving the 328, I’m convinced this will be an amazing swap and worth the effort. Got the donor to pass all monitors. Next I will delete dsc functions to a minimal level and see if the cluster still reads speed and dme is happy. If I read correctly the right rear is where the speed input comes from. Basically I will start unplugging things to get down to a basic elec system Then I’ll clear the monitors and see if they will re run. The moment my registration shows up I will smog my e30 on the old engine then start the swap. This will give me two years(not that I’ll need it) before it has to go back to a smog shop.

There is a direct wire from the dcs to dme for wheel speed on MSV80 as well. I found out chasing a check engine light due to vehicle speed. If I remember it was a DC signal so I'm not sure if the factory speed sensor in the E30 diff could be used or not. Looking at wiring diagrams it is from pin 8 of the DSC to x60001 pin 17 of the DME labeled rr whl out.

I verified that there are no fault codes in DME and no traction intervention with only the right rear wheel speed sensor attached. Next step will be just to disconnect the DSc and see if that sets a ‘CAN with DSC’ fault code. I can at least run a DSC on minimal inputs and have normal DME function.
