The art of the honest apology is disappearing. A good grovel goes a long way to keeping customers, in my regrettable experience. It's not un-manly to apologize when you or your people make an honest mistake.
When you run a shop fixing other people's stuff things happen: That new guy doesn't follow procedures, the torque wrench goes wonky, the studs labelled as x length are actually 9/10 x and the installer doesn't notice or have the knowledge and training to notice and on and on. Part of the life.
People used to understand that stuff would happen. The phrase remains ("S*** Happens.") but the understanding that it really does happen doesn't and it all goes to lawyers.
The shop should have offered the OP an instant apology and covered his costs. Bad cess to them that they didn't. The OP is within his rights and is nowadays even expected to pursue them with a lawyer. That's too bad.
A friend's car got vandalized *in* a dealer's garage. They claimed no responsibility and my friend's lawyers got money off them. The same friends next car got accident-ed by another garage's mechanic on a reckless but not wreck-less test drive. The old guy that ran the shop said "I'm very sorry, that should never have happened and I'll really try to make it up to you."
No lawyers and everybody ended up content, if not happy.

A whole lot of butthurt itt. Curtis- just drop it. You are getting mighty old now... every thread you drop your head in to goes down the drain. Why do you feel it is necessary to kick people while they're down? The guy is doing what is right. Also you're doing well to make the few that didn't already think you were a nob to reconsider.
OP- sounds like you're having a rough time aside from this mess. Don't let the minority get to you. Congrats, it's your money, do as you wish, but be wise with it! I sincerely hope you recover fully from this illness. Please do keep us updated despite the hate you're getting.Tim.

Thanks for the kind words and nice thoughts about the cancer thing. I thought I had mentioned it on here before, but I guess not. Its mid to late stage, and relatively serious. But, it is what it is, and I try not to dwell on it too much. I spend a lot of nights in the hospital hooked up to Morphine or various other opiates and benzodiazepines to calm me down and let me sleep. If anyone cares I can post more details about the exact what's how's and why's of the "Crap That's Killing Ninjaotter."
Anyway, the deal hinges on the apology right now. I'll probably just accept the offer on the table, but the threat of going to court and the massively increased publicity is making them sweat a little bit. There is more than enough money involved at this point to make me happy.

No need to explain any further on your condition if you don't feel comfortable about it. We are all just randoms on a forum who are cheering you on for a good recovery and a good settlement with the douchebag's who ruined your car and potentially harmed you. Anyway, I meet with my lawyer on Monday to discuss whatever they offered. Hopefully I'll have an apology, a check, and a NDA to sign. Well, I dont really want to sign an NDA, but I'm assuming they're going to insist on it. As long as there is an apology attached, I plan on taking the offer. I know it'll be enough to cover what I've lost, and I dont want to push for anymore. If its six figures, its six figures. If it isn't I'm not going to dwell on it. Just means I'll be looking for another E30 instead of an NSX, which isn't the worst thing in the world. It should let me get some wheels, a big brake kit, and some coil overs so I can have some fun. Maybe I'll complete the 5 lug swap I've got in the garage.
Funny story though, the same Les Schwab is being sued by someone else for the exact same thing...it happened yesterday. Someone isn't learning their lesson. I sort of wonder if there might be some faulty equipment involved or something.
If I can post what the final number is, I will. Hopefully with some picture evidence. I am warning you now that I will not jeopardize a cash settlement by breaking a non disclosure agreement just to prove the trolls wrong. So if I come back and say, "Hey, everything is settled!" and provide no additional details, that's what happened. I may even have to edit my old posts or have this thread deleted to satisfy the terms of the NDA. Just watch my threads for the next few months and see what new toys I buy (or dont). Gonna be honest though, I am most excited at finishing my degree.
And on a totally unrelated note, does anyone here from Bellingham own a white 4 door 325ix, stock, and live in the York District? I might leave a note next time I pass your car. I also got to see a Porsche GT3 RS sliding around in the rain. It was a good day for car spotting. A random Ferrari that I couldn't identify because I'm not well versed on late 90's Italian cars, a MK IV Supra wide body, an old school M5 and M6 playing with each other on the freeway, and a fully caged obviously built Evo 9 that went ripping out of a parking lot so hard I think it fractured the black top.

Its too bad. If they had cut a check for the cost of a used body panel, and some of the suspension parts, I would have been happy. That, and an apology. I'm not a litigious guy, and I'm not out to get rich off this. No one got hurt, my car will survive, and I was only slightly annoyed at having to sit on the side of the road for an hour. Now? Its going to cost them a shit load.
It's not about suing them into the ground; it's about making it right.
