    I have an attorney. I got one the day I got out of the hospital. I was there for 5 days. I learned last week I have 7 broken ribs. The pain is pretty hard to bare. I'm hooked on Percocet. Without it, I can't function.

    The biggest problem with this all is the other driver is only 18. He has no assets. His only asset was more than likely the Dodge Dakota pickup that he t-boned me with. Problem with this being he only had liability on it. Meaning its totalled now too, so he has nothing.

    I'm going to be able to get things taken care of. From what I've been told, my health insurance will pick up whatever isn't covered and taken care of. And I will be suing this asshole outside of the insurance settlement to garnish his wages for the rest of his natural life. He's lucky I lived through it all.

    Thanks for your support everyone. And be happy to own e30's. They hold up to their name.

        Yeah... the mixture of your car and medical insurance should get you straight.

            I could only think of about 1093013891981 lawyers that would just love to help you out. The kid was 18, paid his own insurance, and has a f150 truck? He seems like he has a job and can therefore pay you for the rest of his life for being irresponsible and running a redlight at 15mph over the speed limit.

            At the LEAST, he will have to pay your medical bills and for your car, since it is directly his fault that happened. As far as making you miss class or hurting you emotionally, you can prolly get a bit more. I am thinking somewhere in the 50k+ $ range.

            The law is there to protect people from other crazier people. If he doesnt pay out atleast for your injuries and your ix, then he will need some protecting from an angry mob of e-30 enthusiasts. It is obviously not fair to you that he screwed you and your car over, and to protect him from you coming back and killing him, I would hope the law would make sure he pays a hefty fine.

            Glad you made it out alive man, I feel safer driving my ix now that I know it can take a decent hit, but a roll cage just got bumped up the list of my next mods to do.

              Im down in Cbus and dont understand why your worried! State min for auto insurance here in ohio is something like 25-35k property damamge, and 150k bodily injury.

              Does the kid not have auto insurance?

                Minimum liability coverage in Ohio is 25k per person, 50k per accident. If the guy is carrying that, Michael is limited to 25k from the other driver's insurance. If Michael has uninsured/underinsured coverage (which he should) on his own policy, there is more $$ to be had. In theory, he could sue the kid for more and then garnish his wages. Unless he has money (i.e., comes from a wealthy family or something) then it is often more trouble than it is worth. Chasing someone for wage garnishment is a pain in the ass and yields very little unless the guy makes serious stew.

                Make sure your lawyer looks at whether you can go after underinsured coverage on your policy.

                    I think a roll cage would have done a lot more damage than good in that accident. Crushed and bent bars all over the place... an unhelmeted head in the mix.

                      The state minimum in Ohio is actually a whole shit load lower than you guys have stated. The state minimum is $12,500 for bodily injury and $7,500 for property damage.

                      I filed a claim with my insurance company on my policy under the Underinsured section. I am on my own policy with much lower limits than my father has, but had the accident been my fault, I would be much better off.

                      The limits to my policy under the comprehensive is:
                      BI $50,000 EACH PERSON - $100,000 EACH ACCIDENT
                      PROPERTY DAMAGE LIABILITY - $50,000 EACH ACCIDENT

                      Uninsured/Underinsured Motorist Bi
                      $50,000 Each Person - $100,000 Each Accident

                      So since this guy is 'underinsured' for this claim, I can only get $50,000 from my claim total, which is to cover the property damage (my car) and my bodily injury.

                      The state minimum coverage is bullshit. It doesn't cover anything at all and I can't even begin to comprehend how some states don't even have insurance requirements.

                      As far as I know, I am only able to take a settlement from the insurance companies or sue him. I can't do both. But thats why I have my lawyer.

                      Ohh, my car was considered a total loss the other day as well. I am waiting back on the word as to the value of the car. I had an appraisal done the day I bought the car saying it was worth $12,000 and I just recently had another done saying it was worth $10,500-12,000.

                        Yeah right - I was thinking the KY minimums - they are 25/50.

                        You will get his max coverage - they should cut you a check for that without much question. You may have to fight with your UIM though.

                            I would say I have the best luck ever with the car. It saved my life. It's the reason why I'm here. I just wish it had more life in it. I was hoping the car would last me another 17 years.

                            To set the record straight, the other driver was driving a 2002 Dodge Dakota pickup. And he never gave a reason as to why he was speeding and why he went through the red light.
