    Easy, document the crash area. Tell the dealer you are going to have the police investigate. Then go to another dealer and have them download the vehicle history. It should very clearly show the speeds, revs and crash data.

    Sue the pants off of the dealership and threaten to file with the police since the person driving the car would likely get in trouble for an unreported accident.

            That sucks, I hate to hear that. I have worked in several dealerships and it happens everywhere.

            I worked at a Audi dealership around 2001. I think there was a tech fired about every month over the same S4 biturbo. It had a bunch of bullshit on it and was making like 630hp.

                  The DME records everything; they can retrieve the information as to the speed before impact etc. It's done on purpose because of new car warranty. These cars have launch mode and therefore if there is a problem with the car they want to know if it is "driver fault." And yes it is!!! He wrecked your car from negligence and I would have them NOT touch the car; contact a lawyer and and speak with the owner of the dealership or have your lawyer speak with the owner of the dealership. Don't move the car and don't authorize any work. Get an outside appraisal company to est the damage and get it in writing. I new car may not be in order but whatever damage is seen or unseen should be taken care of. However, aside for fixing the car; you should be awarded a handsome compensation package. They may even replace the car just to avoid negative press on further legal hassle. They screwed up BIG and they have to own up to it. I would even go as far as to speak with someone at BMW USA corporate offices.
                  I worked for BMW years back and a car jockey did the same thing. He was fired but I don't know what the outcome was for the customer's car in the end.

                          Seriously? How the fuck do you think they figured out that the "runaway" Toyotas were driver error? The computer controls everything in a new M5 and logs it all. Throttle position, engine speed, vehicle speed, brake position, traction control information. It would be pretty easy to show that they were flooring it and going too fast.

                          Its not cop show shit in modern cars. Hell, its been the case for some time now in higher tech cars. Shit, they can even void your warranty for using unauthorized programming (like the "launch control hack").
