I wonder how many stops this kid went through to get the reaction he was hoping for.
I was just down in Nashville over the 4th and they were saying that all the officers were give. Court orders to take blood tests right on the spot and to not even mess around with a sobriety test. Not sure how it all played out but that sounds a little severe. Especially since how are they going to sterilize the equipment and the test area....oh yeah, with alcohol.Comment

There needs to be a reasonable suspicion that a crime has been committed, not a "gut feeling" or dislike of a person's appearance or demeanor. Pulling a person out of a car because they don't want to roll the window down is pure vindictiveness.sigpic

I dont know about you guys but I get nervous as hell when I get pulled over by a cop. Not because I have anything to hide but because you dont know what type of attitude you might encounter. When I was younger I didnt know the laws that well, so if a cop pulled me over for whatever reason, and wanted to check my car, i would just let him. Only later I found out that I did not have to consent to that and that they actually need a warrant to search my car...unless of course he had probable cause. If I got pulled over today, lets say for speeding, and they asked me if they could search my car, and I say no not without a warrant, am I asking for trouble too? Or am I just exercising my rights as a citizen so that I dont get taken advantage of? What if i had a camcorder and recorded the whole thing, am i provoking the situation?
I dont think the kid did anything wrong. I think the cop got upset that this guy decided not to just do as told like everyone else and it caught him offguard.Comment

I kind of agree, but not entirely. I would have no recourse if the person I was questioning reached for something quickly. There have been plenty of cases where this has happened where the officer was able to subdue the driver by reaching in the car and stopping them while they were reaching. In most cases the person was subdued without severe injury. With the window cracked like that, you, as an officer, need to make a decision that could ultimately mean death for you or the other party. I don't believe its worth putting someone on the defense to exercise your right to a cracked window. Its asinine. Just roll your window down and have a conversation. I bet you go home without having to deal with a bunch of irate officers and a dog. I bet you won't have any tasty you tube footage though.Yours truly,

Just like the guy in the dog shooting vid, when one goes out looking for trouble, one will find it. This is a clear set up on the kid's part, I, like someone else mentioned, wonder how many times this kid drove through the check point hoping to be stopped and "questioned" just so he could post a vid on you tube. Did you get that GoPro for your birthday, bro? Why else is the camera set up with a perfect angle to the driver's window?
Yeah, everyone can argue that you have the right to refuse, the right to keep your window barely cracked, etc, but where does that get you? Standing on the side of the road or in the back of a cruiser while the cops toss your car just because you wanted to be the one guy that night that "Knows my rights !!" How many people do you think the cop has run into that don't want to roll their window down further because they really are intoxicated? Does it look like it's that cop's first night on the job? "Oh they can't detain me, they can't arrest me..." Really? Looks like they just did! Maybe it is a pain, maybe it is a game, but I for one would rather just roll my window down a little further as requested and be on my way versus having anyone see me in the "secondary inspection lane" doing the sidewalk olympics or watching everything in my car being thrown around.Comment

If people would just cooperate with cops and do what they ask and realize that officers are trying to help and protect you/them and other drivers then traffic stops like this would go way smoother. Theres no need to try and exercise your rights when a cop simply asks you to roll your window down, is it really a big deal to just say "ok and here is my ID sir". If you feel that infringes your rights then you are pretty insecure, but I garuntee everytime any of you guys get pulled over you cooperate fully, so you are hypocrits for praising this kid then not excersising your "rights" when you are pulled over anyway.
That being said, yes I agree some cops do get on power trips as does anyone who is given power, but a majority don't, and they actually want to help, but youtube videos and ignorant people like this doesn't help the GOOD cops case at all now does it?Comment

I see your point and I agree with the "defenseless" defense on the cracked window. But, it is not illegal and therefore he was within his rights to keep his window as open as it was. Yes, he could have just complied and opened the window, no big deal, right? But the cop should also know the laws and he should have known that the driver did NOT have to open the window all the way down and therefore he could have just proceeded with his DWI check. I'm not responding to be a prick just playing devils advocate.

I guess from now on Ill just keep my gun in my lap and my window partly down and act sketchy because TECHNICALLY its not illegal, so technically Im within my rights, and when a cop freaks out because he pulled over a guy with a loaded .45 in his lap who wont roll his window down to cooperate its not my fault when he reacts and gets a gut feeling that something may be wrong. Had a gun pulled on me twice by a cop when I had both hands on the wheel, car off, pulled over for speeding and being respectful. I was 16 and 22 years old, and that happens more than you'd expect. That's something to get nervous about. One cop around my area raped women he would pull over. No beuno.
So shooting dogs and people for nothing is obviously taking it too far.Comment

Point is they dont know what I would be planning, just as they dont know what a nervous kid would be planning. Which goes back to what I said before, cops have to take these situations seriously, weather its me with a .45 in my lap or a punk kid acting nervous who is not willing to cooperate with a simple question.Comment
