    But for real what about the guy sitting in his car who wouldnt cooperate, turns out hes packing an ak47 and jumps out of his car unloading on the police? But you wont really hear about that because the cops didnt do anything wrong. Cops are always on their toes, as they should be.

          I have no problem with cops who act like they did back in the day. A cop caught a bunch of us for smoking in a development and told me that he couldn't let me drive cause DUI. So he fucked with us for the 4 mile long walk. That taught us not to be idiots way better than some guy on a power trip.

                  By not rolling his window down while operating his vehicle on a public road and entering a legal checkpoint he did no comply to a request of a peace officer resulting in a compromise of safety. "Am I being detained" only really applies when on foot when an officer can safely asses the situation that surrounds them and the public. Kind of like equal force to defend. An officer on foot has no equal defense or recourse to immediately and safely defend the public compared to an individual in a car, especially when being evasive toward him or her. When it comes to making split second decisions, the phrase " am I being detained" doesnt apply. He was detained the minute he pulled over. As a citizen, if you roll into an announced roadblock ( in many states they must inform the public via a media source) you are detained until the officer sees fit to allow you to proceed to your destination. So If you act right, you get to go. If you act like a fool and refuse to comply, or ask if you are being detained, after you have begun to be evasive and decided to play lawyer, then guess what. You don't get to go perry mason. A lawyers advice is this. If you haven't been drinking, comply. If you have do everything in your power to stall. THATS what the window trick does. Only problem is he messed it up. He should have had his documents ready and stuck them out the window. Then ask what the roadblock was for. In most cases DUI checkpoints are illegal and police say they are license checks. The second your license is deemed legal, you are free to go in such a check. Thats right, you are free to go. An officer cannot detain you further once you have provided them with what they are asking for. This specifically applies in GA because DUI checks are highly illegal without the proper paperwork and due diligence by police. Asking questions that have no bearing on the stop don't help you, they hinder you. Dude doesn't understand the law as It applies to the situation. The cop doesn't care. The rest is in the video. Most may think they get it, but again, the police can say just about anything to justify their actions in this case because the viewer cannot see the entire interaction.
                  The kid would make more progress at the dmv by asking am I being detained.

                  Maybe he could scream 4th amendment next time....... Or maybe 5th..... Shit, go through them all..... Film that, it would be more interesting.

                              Do I have to post this again. DONT TALK TO COPS. while not really approatie to this situation the idea should remain the same. DONT TALK TO COPS, dont tell them anything more than ya have too, who you are is about it.

                              Asking if your being detained means you have now set the ground work that the police must follow procedures not this gray area of what they can get away with in trying to find something to pin on you.

                                As I've written before, this could've been avoided if Harmon-Wright had been properly screened for the job:
                                Soon after Harmon-Wright was arrested, it was revealed that he had a tarnished military record, a drinking problem, and a history of harassing Culpeper residents. The first two problems nearly kept him from getting the job, and no one at the Culpeper Police Department will say why they didn't.
                                I'm not a big fan of locking people in cages, but I find it appalling that Daniel Harmon-Wright is going to do three years for murder while Cook got the death penalty for trying to avoid a confrontation.
