I follow the Adam Carolla school of thought: I don't smoke. I don't care if other people smoke. Why should I burn calories thinking/ worrying about what others want to do thats not effecting me. If people are going to smoke being legal won't change a damn thing. Why are we still on this issue?

Its the owners RIGHT to decide what goes on in his establishment, Property rights trump those of the guests personal rights (to a point) You dont have to go in there that is a choice and you can get your happy ass up and leave.

Here, I cant carry a Weapon into a private businnes that is open to the public or into another persons home if they post a sign saying I cant or they tell me I cant. Why is this??? After all its my 2a rights to carry per my permit right????? Well the property owners RIGHTS TO CONTROL WHAT HAPPENS ON THEIR PROPERTY, trump my personal right to carry there. If I dont like that rule I can just leave or not patronize that place. Same thing applies to the Smoking on private property This would also apply to OUTSIDE on PRIVATE PROPERTY as well.

Yes, I believe it is a right to breath cleanly and someone who sits down next to me and lights up is infringing on that right. If I see someone smoking, of course I choose to reside in another spot but why should I have to move because someone feels they are ENTITLED to smoke wherever they want. For the record, I am mostly referring to outside situations being that I am in Cali where you can't smoke in buildings. In the case of outside Cali, if an establishment allowed smoking inside I would just make the choice to not go there. Have you read anything I have typed at all? When the fuck did I say anything about smoking on private property? I pretty clearly stated that if an establishment explicitly allowed smoking inside, I would steer clear. It is their right to allow it, and it is my right to take my business somewhere else. What I have been saying, maybe read this a few times before you type again just in case these complicated sentences trip you up again, is that it is annoying as fuck when smokers invade your personal space with no regard for anyone but themselves. Here is an example in case that got you confused. I am sitting in front of the dmv waiting for someone on a bench. Someone comes up, sits down next to me and lights up. Here is a big fucking wake up call all you smokers; the only people who are not annoyed by your smoke inhabiting the air in the immediate area is other smokers. Everyone else hates it, it smells like shit and its annoying as fuck. Remember your first cig you stole from your unemployed dad's ripped up daisy dukes? Remember how it made you cough and hurt your throat? Yeah, when you haven't been chain smoking for most of your life inhaling smoke is not pleasant or fun. I don't care if it is outside or inside, it is annoying and yes everyone can smell it. One of the few good things about living in California is that you assholes can't sit in front of an open door smoking away, pretending that you aren't effecting anyone else in the world.

For the record, I see/smell people smoking pot all over public places and it is just as annoying.

You advocate the CA smoking bans in restaurants, bars, shops stores, and other like establishments, do you not????????? In doing so you advocate taking the owners rights to regulate their property. Your statements are are contradictory you cant have it both ways.
Well you see those places are are PRIVATELY OWNED, Not PUBLIC property and the govt has no business sticking its nose in what goes on.

For your question about the CA law banning smoking indoors, it has been in effect since I was a kid so I had no control over that happening. If I had been old enough, I would not have supported government trying to control 1 more thing in our lives. I would not support it on the basis that if you give the government an inch, they will take a mile and start banning everything, eventually it would be something that would hit home for me. Do I enjoy the benefits of this law? Your damn right I do, but there isn't a damn thing that can be done to reverse it so I might as well.
In the case of privately owned but enclosed spaces that people have to use, yes I do agree with banning it, like airplanes.

Not applicable in this argument. Commercial air lines are subject to licensing and regulation of the FAA <----- read F-troop. They can put a no smoking contingency on your license.
