The weather has been making everyone a bit testy lately, I know I have felt like being more of an a$$hole than normal.. Luckily, none of you have to live with me.

It doesn't matter how slippery the road is when it's wet. If you're driving down a 45 degree slope at 1mph and it's covered in pure ice, you obviously will pick up speed and won't be able to stop until you hit something. That is STILL your fault. You are maneuvering the vehicle, it's not driving itself. You chose to bring it to a certain speed in certain conditions in a certain area, that is your responsibility.

There are very few circumstances where you rear end somewhere where it's not considered your fault, and this does not appear to be one of them. Lesson learned, drive slower, keep a greater following distance, and drive more defenselessly then what you did in that situation. None of us are saying we don't do the exact same thing you did (following too close), but if we would have crashed, it would have been our fault, not the weather's fault. When I first got my license I went around a posted 25mph corner in the rain doing about 20mph and slid straight into an oncoming truck. Same deal, oil slick wet roads. The cop actually slid and almost fell getting out of his car, it was bad. He still ticketed me, on top of the insurance claim, because I was driving too fast for the conditions. I haven't been in an at-fault accident since, 300k+ miles and 11 years later. But I've followed too closely, not slowed down enough for the conditions, etc... And had something happened, I'd accept responsibility.

Quit the name calling, really. You aren't 12.

OP, that was an awesome car, sorry to see it smashed up. Hope you get it fixed up or find a suitable replacement, and your own injuries aren't too severe.
I couldn't have said it any better.

      1. Yes. 3, I was at fault for one when I was 16 driving like a cock. Then had my car hit twice.

      2. Nope, I'm too great of a driver to have insurance. Don't you know?

I did almost the same exact thing to my e30 vert back in may. Lady pulled out in front of me in the rain, couldn't stop, car looked almost identical in the front. After fighting with her cut rate insurance they finally took blame and I just refused all their offers until we agreed on what I felt was a fair price. Also try to come up with as many receipts as possible, really helped me. I finally agreed on 7,800 for my car after buying it back, then was able to sell it very quickly for another 2k. I actually felt exactly like you at first, very pissed and I knew my car was not really replaceable, but after all was said and done I feel nearly 10k for the car was more than fair. I wish you the best of luck, sorry to hear the bad news, have any questions feel free to pm.

I agree. But there's also still no reason to be a cock about it and pointing it out, right? Or did I miss something and calling someone a name is bad and being an actual dick to someone after something like this happens is cool? Right? It's not like she posted this in the general forums, the member's rides, etc... it's for people that have met and known her personally that she made a thread explaining what happened. Yes, technically she's at fault. But, it's still an accident. Note the key word, accident. Jesse30 can act perfect and be a dick about it but I'll call him what he's being.

          Keith, it's r3v.

Thanks to all for the support and advice! Means a lot to me. :)

As for me, after the first night of terrible pain and being very depressed about my car, I'm doing a little better, still sore and have a lot of pain throughout my neck and back causing nasty headaches as well. Saw the doctor today and was diagnosed as the much too common "Back/neck strain." I will be looking into physical therapy once my personal injury adjuster calls me.

Right now I am without a car and have not wanted to use my rental insurance until its my absolute last resort because I don't want to use up the coverage right now then shoot myself in the foot to find out later I need it. I'm borrowing my sisters mustang for a few days while I repair her B5 A4 Audi so I can use that for a little more prolonged period. The tech that was working on my E28 got it running today so getting that licensed and tabbed is also an option but reliability is a concern, we will see.

And about the E30 - Yesterday I was able to go back to the place it is at right now to take more pictures and look at things more in depth. Shockingly the bumper is in great condition. There are a few scratches but nothing that can't be sanded down and repainted. The lower part of the valence looks amazing(Along with the lip) but the upper part that goes behind and above the bumper isnt in great shape at all and probably cannot be saved; sucks considering those are hard to find clean like that. We were able to get the hood open surprisingly. I was so shocked to see no major issues with the M20. There are some hoses and such that will need to be replaced due to the fan being pushed up into them. The oil and coolant lines were broken somewhere as the car was still leaking both. It has much potential.

After two days of calling the insurance company trying to figure out why the eff no one had contacted me I finally got the name and number of the assigned adjuster and left him a message. He got back to me about an hour ago. He asked me to gather all receipts for any and all mods even before I told him the car was modified. He explained to me the car is most likely totaled and explained to me all of the options I would have once we get to that point when it is officially determined. Fortunately it seems like I may have lucked out and got a good adjuster who will work completely with me.

At this point I really haven't decided what I want to do yet. There are pros and cons to both fixing this E30 or buying another one(with a manual of course) and swapping everything over. We will see where the future takes me in the next few weeks.
