If you purchase the item with your credit card or Visa/MC check card the merchant terms of accepting your card state that they cannot charge a restocking fee for "no product" exchanges.
This basically means that if you buy something with your CC or Check card and return it, regardless of circumstance, the store must give you a full refund to your card. Otherwise all you have to do is contact your CC company or card issuing bank and file a chargeback claiming that you returned a defective product and the merchant refused to refund all your money. Even if the store has a written agreement that you agreed to the chargeback you will win since it violates Visa/MC acceptance rules on the merchant's end.
Also, as a former employee of a major merchant CC processing network, I've found that in a dispute the bank will side with the card holder 99.9% of the time regardless of the situation. Because the card holder pays alot more in interest on the balance of the purchase than the merchant does and the card holder can simply threaten to stop using the card as to where if the merchant stopped accepting credit cards they stand to lose lots of customers.
